HARTFORD, CT (March 8, 2021) - Judge Thomas Moukawsher has issued a ruling in the school mask lawsuit on the parties’ cross motions for summary judgment.  While the decision stops short of granting relief to the plaintiffs seeking to strike down the school mask mandate, it contains a strong rebuke of the notion that the Governor can exercise unilateral executive authority, even during a pandemic, that continues indefinitely and without legislative oversight.


Attorney Norm Pattis, counsel for the CT Freedom Alliance, LLC, the lead plaintiff in the case, had this to say:


“We are delighted by most of Judge Moukawsher’s decision. He understood the significance of what we argued: There is no public health exception to the rule of law. The Legislature needs to avoid the thralldom of one-party governance and serve its constitutionally appointed role.


“We are concerned by Judge Moukawsher’s passivity as regards waiting for a ruling from the state Supreme Court in another case, a case unrelated to school children. We will be filing an immediate public interest appeal in the Supreme Court asking for permission to be heard as quickly as possible.


“COVID-19 is a terrible virus; it ought not also be the instrument of a coup emboldening the governor and legislature to avoid their constitutional duties.”
